September 2011 Council Meeting Summary

At the September Council meeting held in Charleston, SC, the Council made changes to the development of a number of amendments. A summary for each is included below. Each summary describes changes based on each Amendment's Decisions Document included on the Council website in the September briefing book found at http://www.safmc.net/Meetings/CouncilMeetings/September2011CouncilMeeting/Sept2011BriefingBook/tabid/696/Default.aspx. The Decision Documents used at the Council's last meeting contain basic background information, actions and alternatives, and information the Council needs to consider for each amendment.  These documents will continue to be used regularly at council meetings.

 

Snapper Grouper Amendment 18B – Golden Tilefish

Amendment 18B proposes an endorsement program for golden tilefish. The Council changed their preferred for implementation of a hook and line endorsement program to a preferred for no endorsement program. The Council also removed all alternatives for the hook and line golden tilefish endorsement program that distribute endorsements based on landings made in years older than 2005. The Council decided to postpone further revisions (including those proposed for a longline golden tilefish endorsement) to Amendment 18B until the December 2011 Council meeting in Raleigh, NC.

 

Snapper Grouper Amendment 18A – Black Sea Bass

The Council made several changes to Amendment 18A which proposes biological guidelines, trip limits, and a black sea bass endorsement program. Specific motions made include:

ACTION 2

Added new alternative and choose it as preferred: Alternative 2F (3,500 lbs whole weight on average between 12/8/98 and 12/31/10 using pot gear with at least one pound of BSB between 1/1/08 and 12/31/10) as preferred under Action 2.)

Added a new alternative: Alternative 2G (2,500 lbs whole weight on average between 12/8/98 and 12/31/10 using pot gear with at least one pound of BSB between 1/1/08 and 12/31/10) as preferred under Action 2.)

Made a motion for NMFS to select a date to determine valid number of permits to be considered for an endorsement program. NMFS will prohibit transfers of permits not to exceed 45 days so that endorsements can be distributed.

ACTION 3

Made a motion to accept staff recommendations for wording changes and keep Alternative 2 as preferred.

ACTION 4

Made a motion to allow transfer of endorsements to "immediate family" members.

Made a motion to allow the transfer of a BSB pot endorsement to "immediate family" members (as defined in SG FMP) upon death of a permit holder.

ACTION 5

Change preferred to Alternative 9 (35 traps per vessel).

ACTION 6

No changes

ACTION 7

Simplify Action 7 to eliminate the use of multiyear averages in the recreational accountability measures.

ACTION 8

Move Action 8 to considered but rejected appendix.

ACTION 9

Select Alternative 5 (1,250 lbs gw trip limit) as preferred.

ACTION 10

Move Action 10 to the considered but rejected appendix.

ACTION 11

Accept the staff's proposed wording changes in Action 11.

Move Alternative 2B to the considered but rejected appendix.

ACTION 12

Add proposed Action 12 to Amendment 18A.

ACTION 13

No changes

ACTION 14

No changes

Approve Snapper Grouper Amendment 18A for Public Hearings.

 

Snapper Grouper Amendment 20A – Wreckfish

The Council made changes to the four actions proposed in Amendment 20A which proposes redistribution of wreckfish shares.

ACTION 1

Accept staff recommendations for the minor changes in the language and accept Alternative 3 as the Preferred.

ACTION 2

Move Alternative 5 to the Considered but Rejected Appendix.

Select Alternative 3, Option B, as preferred.

Redistribute any amount in excess of share cap among other shareholders according to the method selected in Action 2 (Alternative 3b).

It is the Council's intent that NMFS administratively prohibit transfers of wreckfish shares for the necessary amount of time, not to exceed 45 days, until the reverted shares are redistributed.

ACTION 3

Select Alternative 4 as preferred (49% share cap).

ACTION 4

Accept the staff's proposed wording changes and choose the new Alternative 2 as preferred.

 

Golden Crab Amendment 6

The Council made several changes to Amendment 6 that proposes a catch share program for the golden crab fishery. The following motions were made:

ACTION 1

Move Action 1 (Implement a catch share program for golden crab) to the considered but rejected appendix.

Note: This action was deemed unnecessary since no other management programs are being considered. A catch share program for golden crab continues to be pursued by the Council.

ACTION 2

Move Alternatives 5-7 to the considered but rejected appendix under Action 2 (Eligibility).

Change 2009 to 2010 in Alternatives 2 and 3 under Action 2 (Eligibility).

Select Alternative 4 as preferred under Action 2 (Eligibility).

Use the control date (12/7/2010) plus six months as a cut-off for Alternative 4 under Action 2.

Establish the timeframes as 1997 through 2010 in all alternatives and sub-alternatives.

Move Alternatives 4-7 and 10 to the considered by rejected appendix.

Move sub-alternatives c, d, e, and f under Alternatives 8, 9, and 11 to the considered but rejected appendix.

ACTION 4

Move Action 4 (Establish Eligibility for Harvest) to the considered but rejected appendix.

ACTION 5

Accept the staff recommendations on Alternatives 1 and Alternative 2 and do not include Alternative 3 under Action 5 (Appeals Process).

Select Alternative 2, sub-alternative A (3%) as preferred under Action 5 (Appeals Process)

ACTION 6

Move Alternative 2 to the considered but rejected appendix under Action 6 (Criteria for Transferability).

ACTION 7

Move Alternatives 6-8 to the considered but rejected appendix and modify Alternative 5 to indicate a maximum of 49% under Action 7 (Share Ownership Caps)

ACTION 8

Move Action 8 (Annual Pounds Ownership Cap) to the considered but rejected appendix.

ACTION 9

Add revised Alternatives 1, 2, and 3 but not 4 under Action 9 (Use or Lose).

ACTION 10

Adopt new languagefor Action 10 (Cost Recovery) and choose Sub-Alt 2b, Sub-alt 3b, Sub-alt 4a as preferred.

ACTION 16

Move Action 16 (Banking and Borrowing) to the considered but rejected appendix.

ACTION 17

Move Action 17 to the considered but rejected appendix.

ACTION 18

Change Alternatives 2 and 3 under Action 18 (Annual Pounds Overage) to 10% and 20% respectively and add language for a payback requirement.

Direct staff to add some verbiage noting that there will be "consultation with state law enforcement" to both sub-alternatives 2a and 2b and select sub-alternatives 2a as preferred.

ACTION 20

Move Action 20 (Adjustments to the TAC) to the considered but rejected appendix.
